Terms and Conditions for Trvl Bestie

Welcome to Trvl Bestie! These Terms and Conditions ("Terms") govern your access to and use of the Trvl Bestie platform, operated by TRVL Bestie B.V. (company registration number 000059837721; VAT number NL005078947B24) ("we," "us," or "our"). By registering for or using our Service, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you must not use our Service.

1. Definitions

Platform: the website, mobile applications, and all related tools, features, and services provided by Trvl Bestie.
User or Member: any individual who registers for an account or otherwise accesses the Platform.
KYC Verification: the Know-Your-Customer process through which we verify a Member’s identity by reviewing government-issued identification documents.
Profile: the personal information, photos, travel preferences, and trip details that a Member provides on the Platform.
Service: the trip-matching algorithm, communication tools, and any additional features offered by the Platform.
Premium Services: paid or subscription-based features and functionality offered on the Platform.

2. Eligibility and Identity Verification

Women-Focused Membership
TRVL BESTIE is designed as a safe and supportive travel community exclusively for women. Membership is available only to individuals whose government-issued identification documents list their gender as female. This verification is required as part of our mandatory KYC (Know Your Customer) process and is intended to ensure the integrity, trust, and safety of our community.
Commitment to Inclusivity
We value and respect individuals of all gender identities and sexual orientations, including those within the LGBTQ+ community. Our women-only framework is designed specifically to foster a secure and comfortable space for female travelers. This policy is based on objective criteria related to ID verification and is not intended to exclude or discriminate, but rather to fulfill regulatory obligations and user expectations for safety.
Age Requirement
By registering, you confirm that you are at least 18 years of age. Accounts created by individuals under 18, those who submit false or misleading information, or those who do not pass KYC verification, may be suspended or terminated without refund.

3. Account Security and User Responsibilities

Account Information: You must provide accurate, current, and complete information when creating or updating your account. You are solely responsible for safeguarding your username, password, and any other credentials.
Authorized Use: You agree not to (i) share your account credentials; (ii) impersonate any person or entity; (iii) use another Member’s account without permission; or (iv) otherwise circumvent any security feature of the Platform.
Communication: All communications between Members must comply with our Code of Conduct (see Section 4). You acknowledge that any interactions—whether online or offline—are at your own risk; we do not supervise, monitor, or control those interactions.

4. Code of Conduct and Prohibited Activities

By using the Service, you agree:

To treat all Members with respect, empathy, and inclusiveness.
Not to post, share, or transmit any content that is unlawful, defamatory, harassing, hateful, pornographic, or otherwise objectionable.
Not to engage in stalking, intimidation, threats, or any form of harassment or coercion.
To respect boundaries and privacy in all communications and interactions.
Not to promote discrimination based on race, religion, nationality, sexual orientation, gender identity, or other protected status.
Not to use the Service for any fraudulent or malicious purpose, including impersonation or misrepresentation.
Not to distribute malware, viruses, or other harmful software.
Not to scrape, harvest, or collect information about other Members without consent.

We reserve the right, but are not obligated, to monitor and remove any user-generated content or account that violates these rules or our community standards.

5. Services, Bookings, and Third-Party Providers

Trvl Bestie facilitates introductions and communication between compatible Members based on mutual preferences. We are not a travel agency, tour operator, or transportation carrier.
All travel arrangements—including accommodations, transportation, tours, and activities—are contracted directly between Members and third-party providers. We are not responsible for the performance, actions, or omissions of such providers.
We are not responsible for disputes or disagreements that may arise between Members, and we are not liable for any harm resulting from such interactions.
Listings, advertisements, or links provided by third parties do not imply endorsement by Trvl Bestie.

6. Fees, Billing, and Refunds

Premium Services require payment of subscription or one-time fees, clearly displayed at the point of purchase.
Payments are processed by trusted third-party payment processors. We do not store full payment card details on our servers.
Unless stated otherwise, subscriptions may renew automatically at the end of each billing period. Users can disable auto-renewal at any time in their account settings.
Fees are non-refundable, except as required by applicable consumer protection laws. For EU consumers, you may have a right to withdraw from digital purchases within 14 days unless the service has been fully delivered.

7. Intellectual Property Rights

All content, trademarks, logos, and software on the Platform are owned by or licensed to Trvl Bestie B.V. and protected by international intellectual property laws.
Members are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.
By posting content to the Platform, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and distribute that content solely for operating and promoting the Service.

8. Privacy, Data Collection, and Security

Please refer to our Privacy Policy for details on how we collect, use, and safeguard your personal data, including:

Types of data collected (e.g., ID verification, usage data)
Use of biometric data
Security practices (e.g., encryption, Azure infrastructure)
Retention periods
Cookie usage and consent preferences
Your rights under GDPR and other laws

You can delete your account at any time within the mobile app. Deletion is permanent and irreversible.

9. Warranties, Disclaimers, and Limitation of Liability

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL TRVL BESTIE B.V., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Trvl Bestie B.V., its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your:

Breach of these Terms
Misuse of the Platform
Violation of rights of another Member or third party

11. Termination and Suspension

You may delete your account at any time via the mobile app. This action is permanent and irreversible.
We may suspend or terminate your access at our sole discretion if you:
- Violate these Terms or applicable law
- Engage in abuse or harassment
- Provide false information
- Pose a security, legal, or reputational risk
- Are subject to a request from law enforcement
We may notify you of suspension and offer an appeal process at [email protected]
Upon termination, rights granted to you under these Terms shall cease. We may retain data as required by law or for dispute resolution.

12. Force Majeure

We are not liable for failure to perform due to causes beyond our control, including natural disasters, war, pandemic, internet outages, or government restrictions.

13. Changes to These Terms

We may revise these Terms at any time. We will notify you of material changes at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands.
Disputes must first be submitted to mediation under the Netherlands Mediation Institute.
For unresolved disputes, the courts of Amsterdam shall have exclusive jurisdiction.
Nothing in this section prevents either party from seeking emergency relief or pursuing claims in small claims court where applicable.

15. Miscellaneous

Severability: If any provision is unenforceable, the remainder will remain in effect.
Entire Agreement: These Terms and the Privacy Policy represent the full agreement.
No Waiver: Failure to enforce a right does not waive future enforcement.
